Terms of Service

These Terms of Service (hereinafter referred to as “the Terms”) set forth the conditions for use of the services (hereinafter referred to as “the Service”) provided by Jewellery Wanderlust (hereinafter referred to as “the Company”) on this website.
All registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.


Article 1 (Application)

  1. These Terms shall apply to all relationships between the User and the Company in relation to the use of the Service.

  2. The Company may establish separate rules, guidelines, or other specific provisions (hereinafter referred to as “Individual Provisions”) regarding the use of the Service. These Individual Provisions, regardless of their titles, shall constitute a part of these Terms.

  3. In the event that any provision of these Terms conflicts with the provisions of any Individual Provision, the provisions of the Individual Provision shall prevail unless otherwise specified.


Article 2 (User Registration)

  1. To use the Service, applicants must agree to these Terms and apply for registration in the manner prescribed by the Company. Registration shall be completed upon the Company’s approval of the application.

  2. The Company may refuse registration in any of the following cases, and shall not be obligated to disclose the reasons for such refusal:
     (1) If false information is provided during the registration process.
     (2) If the applicant has previously violated these Terms.
     (3) If the Company deems the registration inappropriate for any other reason.


Article 3 (Management of User ID and Password)

  1. Users shall manage their user ID and password under their own responsibility.

  2. Users may not transfer, lend, or share their user ID and password with any third party. When a login is performed using a user ID and password combination that matches the registered information, the Company shall regard the use as being made by the registered User.

  3. The Company shall not be liable for any damages arising from the use of a user ID or password by a third party, unless such damages are caused by the Company’s willful misconduct or gross negligence.


Article 4 (Sales Contract)

  1. A purchase contract between the User and the Company shall be concluded when the User makes a purchase request and the Company sends a notification of acceptance. Ownership of the product shall transfer to the User when the Company hands the product over to the delivery carrier.

  2. The Company may cancel the purchase contract without prior notice to the User in any of the following cases:
     (1) If the User violates these Terms.
     (2) If delivery cannot be completed due to an unknown address or prolonged absence.
     (3) If the Company deems that the relationship of trust with the User has been impaired.

  3. Payment methods, shipping methods, cancellation of orders, and return procedures shall be governed by separate rules established by the Company.


Article 5 (Intellectual Property Rights)

All copyrights and other intellectual property rights in the product images, text, and other content (hereinafter “Content”) provided through the Service belong to the Company or the rightful rights holders.
Users may not reproduce, reprint, modify, or otherwise use the Content without permission.


Article 6 (Prohibited Acts)

Users must not engage in any of the following acts when using the Service:

  1. Acts that violate laws or public order and morals.

  2. Acts related to criminal conduct.

  3. Acts that infringe on intellectual property rights such as copyrights or trademarks.

  4. Acts that damage or disrupt the Company’s server or network.

  5. Commercial use of information obtained through the Service.

  6. Acts that may interfere with the operation of the Service.

  7. Unauthorized access or attempts thereof.

  8. Collection or storage of other users’ personal information.

  9. Impersonation of other users.

  10. Direct or indirect provision of benefits to antisocial forces in connection with the Service.

  11. Any other acts deemed inappropriate by the Company.


Article 7 (Suspension of Service)

  1. The Company may suspend or interrupt all or part of the Service without prior notice to Users in any of the following cases:
     (1) When performing maintenance or updates on the Service system.
     (2) When it becomes difficult to provide the Service due to force majeure, such as earthquakes, lightning, fire, power outages, or natural disasters.
     (3) When computers or communication lines are stopped due to accidents.
     (4) When the Company otherwise determines that providing the Service is difficult.

  2. The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service.


Article 8 (Usage Restrictions and Deregistration)

  1. The Company may, without prior notice, restrict a User’s use of all or part of the Service or delete the User’s registration if:
     (1) The User violates any provision of these Terms.
     (2) False information is found in the registration details.
     (3) The User’s registered credit card is suspended.
     (4) The User fails to fulfill payment obligations.
     (5) The User does not respond to communications from the Company for a certain period.
     (6) The User has not used the Service for a certain period.
     (7) The Company otherwise deems continued use inappropriate.

  2. The Company shall not be liable for any damages incurred by the User due to actions taken under this article.


Article 9 (Withdrawal)

Users may withdraw from the Service by following the procedure prescribed by the Company.


Article 10 (Disclaimer and Warranty Exclusion)

  1. The Company makes no guarantees, express or implied, regarding the absence of defects (including but not limited to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security) in the Service.

  2. The Company shall not be liable for any damages incurred by Users arising from the use of the Service. However, if the contract between the Company and a User constitutes a consumer contract under the Consumer Contract Act of Japan, this disclaimer shall not apply. Even in such cases, the Company shall not be liable for any damages resulting from special circumstances (including cases where such damages could have been foreseen) except in cases of gross negligence.

  3. The Company shall not be involved in or responsible for any transactions, communications, or disputes between Users or between a User and a third party in relation to the Service.


Article 11 (Changes to Service Content)

The Company may change or discontinue the Service without prior notice to Users, and shall not be liable for any damages resulting therefrom.


Article 12 (Amendments to the Terms)

The Company may revise these Terms at any time without prior notice if deemed necessary. Continued use of the Service after any such change shall constitute acceptance of the revised Terms.


Article 13 (Handling of Personal Information)

Personal information obtained through the use of the Service shall be appropriately handled in accordance with the Company’s Privacy Policy.


Article 14 (Notices and Communication)

Notices or communications between Users and the Company shall be made in a manner prescribed by the Company.
Unless a change of contact information is properly submitted by the User, the Company shall deem the registered contact information valid and any notices sent to it shall be considered delivered when dispatched.


Article 15 (Prohibition of Assignment of Rights and Obligations)

Users may not assign or pledge their contractual position or any rights or obligations under these Terms to any third party without the prior written consent of the Company.


Article 16 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded.
Any disputes arising in connection with the Service shall be submitted to the exclusive jurisdiction of the court having jurisdiction over the location of the Company’s head office.
